(17)InaccordancewithArticle255(3)oftheECTreaty,each institutionlaysdownspecificprovisionsregardingaccess toitsdocumentsinitsrulesofprocedure.Council Decision93/731/ECof20December1993onpublic accesstoCouncildocuments(1),CommissionDecision 94/90/ECSC,EC,Euratomof8February1994onpublic accesstoCommissiondocuments(2),EuropeanParlia- mentDecision97/632/EC,ECSC,Euratomof10July 1997onpublicaccesstoEuropeanParliamentdocu- ments(3),andtherulesonconfidentialityofSchengen documentsshouldtherefore,ifnecessary,bemodifiedor berepealed, HAVEADOPTEDTHISREGULATION: Article1 Purpose ThepurposeofthisRegulationis: (a)todefinetheprinciples,conditionsandlimitsongrounds ofpublicorprivateinterestgoverningtherightofaccessto EuropeanParliament,CouncilandCommission(hereinafter referredtoas‘theinstitutions’)documentsprovidedforin Article255oftheECTreatyinsuchawayastoensurethe widestpossibleaccesstodocuments, (b)toestablishrulesensuringtheeasiestpossibleexerciseof thisright,and (c)topromotegoodadministrativepracticeonaccesstodocu- ments. Article2 Beneficiariesandscope 1.AnycitizenoftheUnion,andanynaturalorlegalperson residingorhavingitsregisteredofficeinaMemberState,hasa rightofaccesstodocumentsoftheinstitutions,subjecttothe principles,conditionsandlimitsdefinedinthisRegulation. 2.Theinstitutionsmay,subjecttothesameprinciples, conditionsandlimits,grantaccesstodocumentstoanynatural orlegalpersonnotresidingornothavingitsregisteredoffice inaMemberState. 3.ThisRegulationshallapplytoalldocumentsheldbyan institution,thatistosay,documentsdrawnuporreceivedbyit andinitspossession,inallareasofactivityoftheEuropean Union. 4.WithoutprejudicetoArticles4and9,documentsshall bemadeaccessibletothepubliceitherfollowingawritten applicationordirectlyinelectronicformorthrougharegister. Inparticular,documentsdrawnuporreceivedinthecourseof alegislativeprocedureshallbemadedirectlyaccessiblein accordancewithArticle12. 5.SensitivedocumentsasdefinedinArticle9(1)shallbe subjecttospecialtreatmentinaccordancewiththatArticle. 6.ThisRegulationshallbewithoutprejudicetorightsof publicaccesstodocumentsheldbytheinstitutionswhich mightfollowfrominstrumentsofinternationallaworactsof theinstitutionsimplementingthem. Article3 Definitions ForthepurposeofthisRegulation: (a)‘document’shallmeananycontentwhateveritsmedium (writtenonpaperorstoredinelectronicformorasa sound,visualoraudiovisualrecording)concerningamatter relatingtothepolicies,activitiesanddecisionsfalling withintheinstitution ssphereofresponsibility; (b)‘thirdparty’shallmeananynaturalorlegalperson,orany entityoutsidetheinstitutionconcerned,includingthe MemberStates,otherCommunityornon-Communityinsti- tutionsandbodiesandthirdcountries.
